Malkano offers software development, design, consulting, and related professional services. The specific scope, deliverables, timeline, and fees for any engagement are documented in a separate statement of work (SOW), proposal, or master service agreement signed by both parties. In case of conflict, the signed engagement document takes precedence over these Terms.

You agree to use our website only for lawful purposes and in a way that does not infringe the rights of others or restrict their use of the site. You must not:

• Attempt to gain unauthorized access to any part of the website, servers, or related infrastructure.
• Upload or transmit malicious code, viruses, or harmful content.

For client engagements, ownership of deliverables transfers according to the terms of the signed engagement document, typically upon full payment.

Clients are expected to provide timely feedback, approvals, and any materials or access needed to complete the engagement. Delays caused by missing information or late approvals may affect delivery timelines and costs. Clients are responsible for the accuracy and legality of any content or data they provide to us.

Fees, billing cycles, and payment methods are specified in the signed engagement document. Invoices are due within the period stated on the invoice unless otherwise agreed. Late payments may accrue interest and may result in pausing or terminating active work. All fees are exclusive of applicable taxes, which are the client's responsibility.

We treat client information, project materials, and business data as confidential and use reasonable measures to protect it. We are happy to sign a mutual NDA before any detailed discussion. Confidentiality obligations survive the termination of any engagement.

We deliver services with reasonable care and skill and aim to meet the agreed specifications. Beyond that, the website and services are provided on an "as is" and "as available" basis without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement, except as expressly stated in a signed engagement document.

To the maximum extent permitted by law, Malkano Tech shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from your use of the website or our services. Our total aggregate liability for any claim arising out of an engagement shall not exceed the fees paid by the client under that engagement in the twelve months preceding the claim.

Our website may contain links to third-party websites or services that are not owned or controlled by Malkano Tech. We are not responsible for the content, policies, or practices of third parties. Accessing such links is at your own risk.

We may suspend or terminate your access to the website at any time, with or without notice, if we reasonably believe you have violated these Terms. Engagement-level termination is governed by the signed agreement for that project.

These Terms are governed by the laws of India. Any disputes arising out of or relating to these Terms or your use of the website shall be subject to the exclusive jurisdiction of the courts located in Ahmedabad, Gujarat, India, unless another forum is agreed in writing.

We may update these Terms from time to time. The updated version will be posted on this page with a revised effective date. Your continued use of the website after changes take effect constitutes acceptance of the revised Terms.
